These terms of use govern the use of the Tageswerk app and website. By creating an account or using the app, you agree to these terms.

Description of service
Tageswerk is an app for guided daily reflection and habit tracking. The scope of the free tier (e.g. the number of active habits or the length of the visible history) may be limited; the current limits are shown in the app.
Tageswerk is currently in beta, and all features are available free of charge. Paid add-on features (a premium subscription) may be introduced at a later point. If that happens, these terms will be extended with the then-applicable pricing, subscription terms and withdrawal notices before any paid features are activated. In-app purchases are processed through the respective app store (Apple App Store or Google Play); those stores act as the contracting party for the payment transaction, and their terms of use and payment terms apply in addition to these terms.
Registration and user account
Using Tageswerk requires a user account. Sign-up requires a valid email address; the information you provide must be accurate and kept up to date.
You are responsible for keeping your credentials (email access, and any password) confidential and for all activity that occurs through your account. If you suspect unauthorized access, notify us immediately at contact@tageswerk.app.
An account is intended for personal use by one natural person.
Tageswerk is intended for people aged 16 and over. If you are under 16, you may only use Tageswerk with the consent of a parent or legal guardian pursuant to Art. 8 GDPR.
Your obligations when using the service
You agree to use Tageswerk only within the bounds of applicable law and these terms. In particular, you may not attempt to gain unauthorized access to other users' accounts or to Tageswerk's systems, scrape the app or website in an automated manner, introduce malicious software, or otherwise use the service in a way that impairs third parties or the operation of the service.
If you breach these obligations, we may restrict access to your account or suspend it.
Your data and content
The habits and reflection entries you create remain your data. You can delete them completely at any time directly within the app; details on how we process your data are set out in the privacy policy.
Tageswerk's brand, name, logo and software are protected by copyright and trademark law. These terms grant you a simple, non-transferable right to use the app for its intended purpose for as long as you use it.
Availability and changes to the service
We aim to keep Tageswerk reliably available but cannot guarantee uninterrupted availability, for example during maintenance, technical faults, or outages at upstream providers. Recording reflections continues to work locally on your device even without an internet connection and syncs automatically once a connection is available again.
We may adapt, extend or discontinue individual features of Tageswerk over time, provided this does not unreasonably impair the app's core purpose of daily reflection.
Termination and account deletion
You can delete your account at any time, without giving a reason, directly within the app; this also irrevocably deletes your usage data (see the privacy policy).
We may suspend or delete your account with reasonable advance notice in the event of a serious or repeated breach of these terms. The right to terminate for good cause remains unaffected for both parties.
Liability
We are liable without limitation for intent and gross negligence, under the German Product Liability Act, and for damages arising from injury to life, body or health.
For slightly negligent breaches of material contractual obligations (cardinal obligations) — those whose fulfillment makes proper use of Tageswerk possible in the first place and on whose observance you may regularly rely — liability is limited to the foreseeable damage typical for this type of contract. Beyond that, liability for slightly negligent breaches of duty is excluded.
Tageswerk does not replace medical, psychological or therapeutic advice. The app is intended for personal reflection and habit tracking; for health-related concerns, please consult a qualified professional.
Changes to these terms
We may amend these terms, for example when introducing new features, paid offerings, or for legal reasons. We will inform you of material changes with reasonable advance notice, for instance within the app or by email. If you do not object within the stated period, or if you continue to use Tageswerk after the changes take effect, the amended terms are deemed accepted; for material changes to your disadvantage, we will separately point out your right to object and the consequences of objecting.
Governing law and jurisdiction
These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the country in which you have your habitual residence remain unaffected.
If you are a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with this contractual relationship is the provider's place of business.
